Terms of use
Last updated 6 November 2026. These terms cover this website. Irate services are provided under a separate written agreement.
1. These terms
These terms apply to your use of irate.ai and its pages (the "site"), which is operated by ApexOne, the trading name of APX 1 Pty Ltd (ACN 690 198 684) as trustee for the APX1 Trust (ABN 65 471 502 316) ("Irate", "we", "us"). By using the site you agree to them. If you use the site on behalf of an organisation, you agree for that organisation.
The Irate platform and managed services are provided only under a signed agreement, order or proof-of-concept agreement. If anything in that agreement conflicts with these terms, the agreement wins. Procurement and legal teams can request our standard agreements, data processing addendum and mutual NDA at [email protected].
2. Using the site
You may browse the site, share links to it and download materials we publish for that purpose. You must not:
- use the site in breach of any law, or to send unlawful, misleading or harmful material;
- try to gain unauthorised access to the site, the Irate console or any system behind them;
- scan, probe, load-test or attack the site, or interfere with its operation, except under the security research terms below;
- introduce malware or use automated tools to scrape the site at a volume that affects others;
- submit someone else's details in our forms, or impersonate anyone;
- copy the site, or use its content to build a competing product or service.
3. Security research
We welcome good-faith reports of vulnerabilities. Email [email protected] (also listed in our security.txt) and give us reasonable time to fix the issue before telling anyone else. Test only against your own accounts, do not access, change or keep other people's data, avoid degrading service, and stop as soon as you confirm an issue. If you follow these rules, we will not pursue legal action against you for that research. Testing of client environments is never permitted.
4. Information on the site
- Site content is general information about Irate. It is not security, legal or professional advice for your situation.
- Product screens marked as sample data, and the figures shown in them, are illustrations, not results from a specific client.
- Customer stories are anonymised and describe real engagements; results in your environment will differ.
- Features, integrations and service levels can change. What we commit to is set out in your agreement. Pricing is provided by engagement.
5. Intellectual property
The site and its content, including text, design, graphics, code, the Irate name and logo and the Active Counter Defense™ mark, belong to us or our licensors. Except as these terms allow, you may not copy, adapt, republish or use them without our written permission.
Other companies' names and logos on the site belong to their owners. They are shown to identify products Irate works with; this does not mean those companies endorse Irate or are our partners, unless we say so expressly.
6. What you send us
We handle the details you submit in line with our Privacy notice. Please send only what we need to respond; for an active incident, share sensitive evidence only once we have agreed a secure channel. If you give us feedback or ideas, we may use them without any obligation to you.
7. Other websites
Links to other websites are provided for convenience. We do not control them and are not responsible for their content or privacy practices.
8. Availability
We aim to keep the site available and accurate, but we do not promise it will be uninterrupted, error-free or always current. We may change, suspend or withdraw any part of it at any time.
9. Your consumer rights
Nothing in these terms excludes, restricts or modifies any right or remedy, including a consumer guarantee under the Australian Consumer Law, that cannot lawfully be excluded. Where our liability for such a guarantee can be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
10. Disclaimer and liability
Subject to section 9, the site is provided "as is". To the extent the law allows, we exclude all warranties about it, and we are not liable for any indirect or consequential loss, or any loss of data, profit, revenue or business opportunity, arising from your use of the site or reliance on its content, however caused. This section does not limit liability under a signed agreement with us, which is governed by that agreement.
11. Indemnity
If you breach these terms and that breach causes a claim against us, you agree to cover our reasonable losses and costs from that claim, except to the extent we caused them.
12. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.
13. General
If any part of these terms is unenforceable, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. We may update these terms by publishing a new version here with a new date; the version in place when you use the site applies.
